Requirements for a Building Permit

New Construction

Residential – Two (2) sets of plans

Single Family Dwelling

§        Site plan with structure dimensions to property lines.

§        Foundation Plan.

§        Framing Plan to include roof.

§        Floor Plan.

§        Electrical, Plumbing and Mechanical Plan.

§        N, S, E, and W Elevation Plan.

§        Elevation Certificate if in the Flood Zone.

§        List Total Cost of Project.  (Include Material and Labor) Include all flat work. (Driveways, sidewalks, and patios) Do not include in cost of the property.

§        Energy Code Check (REScheck) to be submitted with plans.

§        Water and Sewer Tap Fees and Water Deposit.

Commercial – Over $8,000.00

Includes Multi-Family Dwellings, Apartments, etc.

§        Two (2) complete sets of Engineer Stamped plans for Building, Mechanical, Plumbing and Electrical.

(Fire Sprinkler, Fire Alarm, if applicable)

§        Certificate of Elevation if in the Flood Zone.

§        List Total Cost of Construction. (Include Material and Labor)  Include all flat work. (Driveways, sidewalks, and patios) Do not include cost of the property.

§        Energy Code Check (Comcheck-EZ) shall be submitted with plans (REScheck for R-Occupancy).

§         TDLR Registration number for accessibility standards compliance-($50,000 or greater for projects)

§        Water and Sewer Tap Fees and Water Deposit.

DEMOLITION:

§ Prior to demolition, all utilities need to be disconnected and/or completely removed; i.e. water, sewer, gas and electricity.

§         Once demolition is completed, all sanitary drain lines need to be capped off.

§         An asbestos survey must be conducted in accordance with the Texas Asbestos Health Protection Rules (TAHPR) and the National Emission Standards for Hazardous Air Pollutants (NESHAP) for the areas being renovated and/or demolished in public and/or commercial buildings.

REMODELING – Residential or Commercial

§         Site Plan with structure dimensions to property lines.

§         Two (2) sets of plans detailing existing and proposed construction.

§         Construction Drawing showing type, size and kind or material and measurements for new construction.

§        Certificate of Elevation if in the Flood Zone.

§        List Total Cost of Project. (Include Material and Labor.) Include all flat work. (Driveways, sideways, and patios) Do not include cost of the property.

All of the above requirements for a Building Permit must also include the following:

Ø      Notification of Disposal of Debris.


Requirements for an Electrical Permit

§         Any projects requiring electrical work/permits must be obtained by a State licensed electrical contractor.

§         Exception:

A homeowner can obtain an electrical permit with proof of a Homestead Exemption.


Requirement for a Mechanical Permit

§         Any projects requiring mechanical work/permits must be obtained by a state licensed mechanical contractor.

§         Exception:

A homeowner can obtain a mechanical permit with proof of a Homestead Exemption.


Requirements for a Plumbing Permit

§         Any projects requiring plumbing work/permits must be obtained by a state licensed plumber.

§         Exception:

A homeowner can obtain a plumbing permit with proof of a Homestead Exemption.


Required Fees for Permits

Building and Sign Permit Fees

TOTAL VALUATION FEES

$1,000 and Less                $20.00 fee up to the first initial thousand.

$1,000 to $50,000            $20.00 for the first $1,000.00 plus $6.00 for each additional thousand or fraction thereof, to and including $50,000.00.

$50,001 to $100,000        $314.00 for the first $50,000.00 plus $5.00 for each additional thousand or fraction thereof, to and including $100,000.00.

$100,001 to $500,000      $564.00 for the first $100,000.00 plus $4.00 for each additional thousand or fraction thereof, to and including $500,000.00.

$500,001 and up              $2,164.00 for the first $500,000.00 plus $3.00 for each additional thousand or fraction thereof.

When the valuation of the proposed construction exceeds $1,000.00 and a plan is required to be submitted by Section 18-68, a plan-checking fee shall be paid to the City of Wharton once the plans have been approved. Said plan-checking fee shall be equal to 25% of the building permit fee. Such plan-checking fee is in addition to the building permit fee.

Fee for inspecting heating, ventilating, ductwork, air-conditioning, exhaust, venting, combustion air, pressure vessel, solar, fuel oil and refrigeration systems and appliance installations.

Electrical and Plumbing Permit Fees

The fees for electrical and plumbing permits vary per project and are best to be discussed on a case by case basis.


Required Licenses and Fees

Electrical Contractors MUST

¨      Hold a valid and unexpired State of Texas Master Electricians License and a State of Texas Electrical Contractors License.

¨      Show Texas Driver's License.

¨      Certificates of Insurance in the same amounts as required by the Texas Department of Licensing and Regulations.

Mechanical and Plumbing Contractors MUST

¨      Show Texas Driver's License.

¨      Show State License.

¨      Required general liability insurance certificate.


Penalties:

Where work for which a permit is required by the City of Wharton is started or proceeded prior to obtaining a permit, the fees herein specified shall be doubled but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this code in the execution of work nor from any other penalties prescribed herein.

According to Section 1-5 of the City of Wharton Code of Ordinances the penalty for violating any City Ordinance is as follow unless otherwise stated:

Sec. 1-5.            General penalty for violations of Code; continuing violations.

(a)                The maximum fine for violating any ordinance, rule or police regulation that governs fire safety, zoning or public health and sanitation, including dumping of refuse, shall not exceed $2,000.00; for all other violations, the maximum fine shall not exceed $500.00. Each day any violation of this Code or of any ordinance shall continue shall constitute a separate offense.

(b)               All other ordinances of the city containing fines and penalties for violating any ordinance, rule or police regulation that governs fire safety, zoning or public health and sanitation, including dumping of refuse, are amended to provide for a maximum penalty not to exceed $2,000.00, and all other fines and penalties for other violations are increased to provide for a maximum fine not to exceed $500.00.
